What Is Oklahoma Move Over Law? 

The Oklahoma Move Over Law (OK Stat. tit 47, §11-309.2) is designed to protect roadside emergency and law enforcement personnel from harm due to passing motorists.

 

This law requires drivers to move over one lane or slow down when approaching an emergency vehicle that is stopped on the side of the roadway with its lights flashing or rotating.

 

If you are unable to move over one lane due to traffic or other conditions, you must slow down to a speed of 20 mph less than the posted speed limit.

 

Drivers should be aware that the Move Over Law applies to many vehicles, not just emergency responders. It applies to tow trucks, highway maintenance workers, animal control officers, construction vehicles, and any other vehicle that has its lights flashing or rotating.

The Severity of Oklahoma Move Over Law Violations

Failing to comply with the Move Over Law can result in criminal and administrative penalties. It is classified as a misdemeanor offense and carries a fine of up to $500 and up to one year in jail.

 

The law also comes with administrative penalties, including a $250 fine and four (4) points on your license.  Additionally, if a violation leads to injury or death, you could be charged with a felony and could face up to five years in prison.
